Dr. David Rees Sperry, a retired dentist from Newark, has decided to plead no contest to the felony charges filed against him. The 68-year-old dentist from Naples, Florida, was accused of having grabbed two teenaged boys at the beach, and coerced them to participate in oral sex with him.
Specific charges were for lascivious and lewd battery. The second charge against him was using a boy aged merely 14 years, for sex. The second felony charge is enough to put him behind bars for almost 15 years in this state.
If Dr. Sperry had not chosen to plead no contest, the matter would have reached trial court, where defense attorneys would have tried to get a lesser sentence for him, on the grounds that he was under medication for dementia and Parkinson’s, and that because of these ailments, he was not aware of what he was doing.
In February this year, the charges filed by the other teenager who was 18 years of age were dropped. This man had accused Sperry of grabbing him, and a sexual battery felony was filed against Sperry.
Dr. Sperry has been denying these accusations so far. This reversal in plea follows the DNA test results given to the office of the State Attorney. They confirmed the presence of the dentist’s DNA.
Medical professionals will now be giving a testimony at the hearing, and try to get easier sentence like house arrest, or probation for him. Sperry has been out of the prison on $50,000 bond, following his arrest on April 3, 2007. The deputies who investigated Sperry’s things in his house found transparent bathing clothes of men, some suntan lotion, a few toothpicks, and a condom in a backpack.
